Preliminary hearing in murder case continues

The court heard a second day of testimony Nov. 13 in a preliminary hearing to determine if there is probable cause to set a trial date for Darrin Edward Bowman, who is suspected of killing David Nichols.
Judge Kurt Horton presided over the pretrial hearing in 18th Judicial District Court. The prosecutors, Byron Jones and Patrice Engel, argued they have more than enough evidence to have Bowman tried for first-degree murder in the case. The public defenders, Michael Onstedt and Steve Schultz, maintains that based on the evidence, the charges probably should be second-degree murder and, if that is the case, they ask the judge to set bail for the defendant.
Because of the complexity of the trial and the testimony, the proceedings were expected to stretch into the afternoon of Nov. 13 and the judge may decide not to make a ruling until next week.
According to testimony, Nichols was shot and killed June 3 behind the house at 4087 S. Clarkson St.
Authorities say Bowman shot Nichols, loaded his body into the back of a light-colored sport utility vehicle with a pickup bed on the rear and left the scene.
Englewood Detective Acel Rowley testified that Englewood police attempted to stop a vehicle matching that description, the driver refused to stop and police chased the vehicle until they lost it west of the city.
The prosecution maintains Bowman drove to a condominium in Silverthorn, where, with the help of a friend, he allegedly dumped the body at the top of a runaway truck ramp on Vail pass.
